Terms of Service
By accessing or using Writerpenny Marketplace, you agree to be bound by these Terms. Please read them carefully before creating an account or placing any order.

1. Definitions
- "Platform" refers to marketplace.writerpenny.com and all associated subdomains of writerpenny.com
- "Buyer" / "Client" refers to any registered user who purchases products or commissions services on the Marketplace
- "Writer" / "Creative" refers to any registered user who lists services or products on the Writers' Storefront
- "Order" / "Contract" refers to a confirmed engagement between a Buyer and a Writer, with escrow locked
- "Escrow" refers to the platform-held fund that is locked upon order creation and released upon Buyer approval
- "Vault Library" refers to the Buyer's personal archive of purchased digital products
- "Custom Request" / "Brief" refers to a Buyer-posted project description to which Writers may apply
- "Wallet Balance" refers to the Buyer's funded account balance held on the platform for use in transactions
2. Eligibility & Account Registration
You must be at least 18 years of age to create an account and use this platform. By registering, you represent and warrant that:
- You are at least 18 years old and legally capable of entering into contracts
- All registration information you provide is accurate, current, and complete
- You will maintain the accuracy of your information and update it promptly if it changes
- You are the sole authorised user of your account and will not share login credentials
- You will notify Writerpenny immediately if you suspect unauthorised access to your account
Writerpenny reserves the right to refuse, suspend, or terminate any account at its sole discretion, with or without notice, if it determines that the account holder has violated these Terms or engaged in fraudulent, abusive, or harmful activity.
3. Wallet, Payments & Paystack
Funding your wallet: Buyers may fund their platform wallet via the Paystack payment gateway. Accepted methods include debit cards (Mastercard, Visa, Verve), bank transfers, and Paystack virtual accounts. Minimum deposit is ₦100. Funds reflect immediately upon successful Paystack transaction confirmation.
Paystack relationship: Writerpenny uses Paystack as its payment processor. By making a payment, you also agree to Paystack's Terms of Service and Privacy Policy. Writerpenny does not store, process, or have access to your card details.
Wallet balance: Your wallet balance is a platform credit held by Writerpenny Ltd. It is not a bank deposit, does not accrue interest, and is not covered by Deposit Insurance Corporation (NDIC) schemes.
Withdrawal of wallet balance: Wallet balances are non-withdrawable except in the case of account closure or where Writerpenny Ltd determines a refund is owed due to platform error. All funds are intended for use on the platform only.
All prices and balances on the platform are displayed in Nigerian Naira (NGN) by default. Users can choose their preferred payout method for withdrawals, including USD, USDT, USDC, or NGN payout options. If a different payout method is selected, the displayed value may be converted to the selected currency based on the applicable exchange rate. NGN payout allows users to make instant withdrawals where available.
4. Escrow System & Order Process
The Writerpenny escrow system operates as follows:
- Order creation: When a Buyer hires a Writer (by clicking "Fund & Launch Order" or "Accept & Lock Escrow"), the agreed amount is immediately deducted from the Buyer's wallet balance and placed into escrow
- Delivery: The Writer submits the completed work via the platform. The Buyer receives a notification and can inspect the delivery file in their dashboard
- Review period: The Buyer may inspect the delivery, download it for review, and either release payment or request revisions. There is no automatic release timer — funds remain locked until the Buyer takes action
- Release: When the Buyer clicks "Accept Work & Release Escrow," the funds are transferred to the Writer's earnings account immediately
- Revisions: The Buyer may request revisions before releasing payment. There is no pre-set limit on revision rounds unless specified in the original service listing
Writerpenny's role: Writerpenny acts as a neutral escrow holder and platform facilitator. We are not a party to the contract between Buyer and Writer and do not guarantee the quality, accuracy, or fitness of any content delivered.
5. Buyer Obligations
As a Buyer on Writerpenny, you agree to:
- Provide clear, accurate, and complete project instructions when placing an order
- Review delivered work in a timely manner (within 14 days of delivery, unless otherwise specified)
- Release escrow promptly once you are satisfied with the delivery
- Use revision requests in good faith — not as a tactic to avoid paying for satisfactorily completed work
- Not attempt to communicate with Writers outside the platform to circumvent Writerpenny's escrow system
- Not misuse the support ticket or dispute system to file false, malicious, or bad-faith reports against Writers
- Maintain sufficient wallet balance before placing orders or accepting Writer applicants
6. Writer Obligations
Writers using the platform agree to:
- Deliver original, plagiarism-free work that meets the Buyer's stated instructions
- Communicate any delays or issues promptly through the platform
- Not cancel orders without genuine cause — repeated unjustified cancellations may result in account suspension
- Accurately represent their skills, credentials, portfolio, and professional certificates on their storefront
- Not solicit Buyers to transact outside the Writerpenny platform
7. Digital Products & Vault Library
Digital products (ebooks, templates, content packs, and similar items) listed on the Browse Products section are sold as single-user licenses. Upon purchase:
- You receive a permanent, non-exclusive, non-transferable license to use the purchased content for personal or commercial purposes as specified by the seller
- You may not resell, redistribute, or sub-license the purchased content without explicit written permission from the original author
- Purchased products are stored indefinitely in your Vault Library and may be re-downloaded at any time while your account remains active
- All sales of digital products are final. Refunds are not available for digital products once downloaded, except where the product is materially different from its description
8. Custom Service Requests
When a Buyer posts a Custom Service Request (brief):
- The request is published to the marketplace and is visible to all verified Writers
- Writers may apply with proposals and quoted prices. The Buyer is under no obligation to accept any applicant
- Accepting a Writer applicant locks escrow for the quoted price. The Buyer must have sufficient wallet balance at the time of acceptance
- Closing a request does not trigger any financial obligation — only accepting a Writer applicant creates a binding order
- Writers not selected for a request are notified of their status (Rejected or Not Selected) but incur no penalty
9. Cancellations & Refunds
Writer-initiated cancellations
If a Writer cancels an accepted order, the full escrowed amount is automatically refunded to the Buyer's wallet balance. No action is required from the Buyer.
Buyer-initiated cancellations
Buyers may not unilaterally cancel an order once escrow has been locked and the Writer has begun work without the Writer's agreement. Disputes over cancellations should be raised through the Support Ticket system.
Digital product refunds
Digital product purchases are non-refundable once the file has been downloaded or accessed via the Vault Library. Exceptions may be made at Writerpenny's sole discretion where the product is materially different from its description.
Writerpenny does not issue cash refunds to bank accounts. All refunds are credited to the Buyer's platform wallet and may be used for future transactions on the platform.
10. Intellectual Property
Platform content: All design, branding, UI elements, logos, and platform copy are the property of Writerpenny Ltd and may not be reproduced without written permission.
Commissioned content: Upon full escrow release for a completed order, the Buyer obtains full ownership of the commissioned content unless a different arrangement is explicitly specified in the order instructions and agreed to by both parties.
Product purchases: Purchases of digital products grant a non-exclusive license as described in Section 7. Full copyright remains with the original author unless explicitly transferred in writing.
Portfolio use: Writers may retain the right to add commissioned work to their portfolio unless the Buyer explicitly requests confidentiality in the order instructions, and the Writer agrees to such terms.
11. Prohibited Conduct
The following actions are strictly prohibited and may result in immediate account suspension or permanent termination:
- Circumventing the escrow system by soliciting or accepting direct payments outside the platform
- Submitting plagiarised, AI-generated (where not disclosed), or copyright-infringing content as original work
- Filing false, malicious, or bad-faith dispute tickets or ratings
- Creating multiple accounts to circumvent suspensions or game the rating system
- Using the platform to commission illegal, defamatory, hateful, or explicitly sexual content
- Attempting to access, reverse-engineer, or interfere with the platform's codebase or server infrastructure
- Fraudulent payment activity, including chargeback abuse
- Sharing account credentials with third parties or allowing unauthorised use of your account
12. Support, Disputes & Ticket System
All disputes, complaints, and support requests must be raised through the designated channels:
- Registered buyers: Use the "Support & Reports" ticket system in your dashboard. Provide full details, relevant order IDs, Writer IDs, and any evidence
- Pre-registration: Use the Contact form on this website
Writerpenny will review all dispute tickets and respond within 48–72 business hours. Our decision on disputes is final for platform-level resolutions, though this does not affect your statutory legal rights.
Writerpenny reserves the right to issue partial or full refunds, adjust escrow holdings, or suspend accounts as a result of dispute investigations.
13. Limitation of Liability
To the maximum extent permitted by applicable law:
- Writerpenny Ltd is not liable for the quality, accuracy, fitness for purpose, or legality of any content commissioned or purchased through the platform
- Writerpenny Ltd is not liable for any indirect, incidental, consequential, or punitive damages arising from use of the platform
- Writerpenny Ltd's total aggregate liability to any Buyer for any claim arising from use of the platform shall not exceed the total amount paid by that Buyer to Writerpenny in the 12 months preceding the claim
- Writerpenny Ltd is not responsible for Writer conduct, Writer-delivered content, or outcomes resulting from a Buyer's use of commissioned content
14. Platform Availability & Changes
Writerpenny strives to maintain platform availability but does not guarantee uninterrupted access. We reserve the right to:
- Modify, suspend, or discontinue any platform feature with or without notice
- Update these Terms at any time — material changes will be communicated to registered users
- Adjust service fees, commission structures, or platform policies — registered users will be given reasonable notice of any changes that materially affect existing orders
15. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Federal Republic. Any dispute arising under these Terms that cannot be resolved through Writerpenny's internal dispute resolution process shall be subject to the exclusive jurisdiction of the US courts.
